Divers r\u00e9gimes s\u2019appliquent selon le cas pr\u00e9cis et les objectifs vis\u00e9s.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Le bail d\u00e9rogatoire ou \u201cbail de courte dur\u00e9e\u201d est un contrat de location de courte dur\u00e9e de locaux utilis\u00e9s par les commer\u00e7ants, artisans ou professionnels dans l\u2019exercice de leur activit\u00e9 (article L. 145-5 du Code de commerce).<\/p>\n<h2>Les conditions \u00e0 remplir pour un bail d\u00e9rogatoire :<span class=\"Apple-converted-space\">\u00a0<\/span><\/h2>\n<p>La loi Pinel du 18 juin 2014 a apport\u00e9 des modifications au <a href=\"https:\/\/www.gridky.com\/blog\/bail-commercial-et-loi-pinel-lessentiel\/\">r\u00e9gime des baux commerciaux<\/a> et notamment au r\u00e9gime du bail d\u00e9rogatoire.<\/p>\n<p>Un propri\u00e9taire peut conclure un bail d\u00e9rogatoire avec un locataire d\u00e8s lors que les 3 conditions suivantes sont remplies :<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<ul>\n<li>En vertu des nouvelles dispositions prises dans la loi Pinel de 2014, <b>la dur\u00e9e totale des baux ne doit pas d\u00e9passer trois ans (36 mois)<\/b><\/li>\n<li>Le <b>contrat de bail est conclu lors de l\u2019entr\u00e9e dans les lieux<\/b> du locataire<span class=\"Apple-converted-space\">\u00a0<\/span><\/li>\n<li>Le propri\u00e9taire et le locataire ont <b>inscrit sans ambigu\u00eft\u00e9 au contrat leur intention de ne pas \u00eatre soumis au statut des baux commerciaux<\/b><\/li>\n<\/ul>\n<h2><b>L\u2019expiration du bail :<span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/h2>\n<p>A noter que le bail d\u00e9rogatoire ne permet pas au locataire de b\u00e9n\u00e9ficier du<b> droit au <a href=\"https:\/\/www.gridky.com\/blog\/le-renouvellement-du-bail-commercial-avec-la-loi-pinel\/\">renouvellement de bail<\/a><\/b> et aucune partie ne peut donner cong\u00e9 avant la fin de la p\u00e9riode pr\u00e9vue.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Avant 2014, si le locataire restait dans le local \u00e0 l\u2019assentiment du bailleur, il s\u2019op\u00e9rait automatiquement un nouveau bail commercial. Depuis l\u2019entr\u00e9e en vigueur de la loi Pinel 2014, les parties peuvent, au-del\u00e0 du d\u00e9lai de 36 mois, rester dans les lieux <b>un mois suppl\u00e9mentaire afin de prendre position<\/b> sur la volont\u00e9 soit de mettre fin au bail d\u00e9rogatoire, soit de le transformer en un bail de droit commun, soumis au statut des baux commerciaux.<\/p>\n<h2>Le cas particulier des locations saisonni\u00e8res<span class=\"Apple-converted-space\">\u00a0<\/span><\/h2>\n<p>Enfin,<b> les locations saisonni\u00e8res sont <u>exclues<\/u> du domaine des baux d\u00e9rogatoires<\/b>.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>La notion de \u00ab saison \u00bb correspond plut\u00f4t \u00e0 la saison touristique laquelle varie selon le lieu de situation de l&rsquo;immeuble lou\u00e9 et non \u00e0 une dur\u00e9e fix\u00e9e contractuellement.<\/p>\n<p><b>Attention !<\/b><span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>La loi Pinel impose en effet au locataire l\u2019obligation de faire du bien lou\u00e9 sa <b>r\u00e9sidence principale<\/b> et l\u2019impossibilit\u00e9 de le sous louer.<\/p>\n<p><b>D\u00e8s lors, <u>la location saisonni\u00e8re, type Airbnb, n&rsquo;est pas compatible avec le r\u00e9gime Pinel<\/u> pendant toute la dur\u00e9e du dispositif de d\u00e9fiscalisation.<span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/p>\n<p><em>NB : Si vous souhaitez b\u00e9n\u00e9ficier d&rsquo;une source r\u00e9guli\u00e8re de revenus, tout en b\u00e9n\u00e9ficiant d\u2019une fiscalit\u00e9 int\u00e9ressante, le mieux est peut-\u00eatre d&rsquo;opter pour un <a href=\"https:\/\/www.gridky.com\/lmnp\"><strong>investissement sous le statut LMNP<\/strong><\/a> (r\u00e9sidence g\u00e9r\u00e9e ou de services).<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Si la dur\u00e9e de location moyenne d\u2019un bien s\u2019\u00e9tablit entre un \u00e0 trois ans, bailleurs comme locataires peuvent vouloir conclure un contrat de location temporaire plus court.
