{"id":11481,"date":"2021-01-12T13:59:00","date_gmt":"2021-01-12T13:59:00","guid":{"rendered":"https:\/\/www.gridky.com\/blog\/?p=11481"},"modified":"2021-01-12T14:05:47","modified_gmt":"2021-01-12T14:05:47","slug":"repartition-des-charges-ce-que-dit-la-loi-pinel","status":"publish","type":"post","link":"https:\/\/www.gridky.com\/blog\/repartition-des-charges-ce-que-dit-la-loi-pinel\/","title":{"rendered":"R\u00e9partition des charges  : ce que dit la loi Pinel"},"content":{"rendered":"<p><span style=\"font-weight: 400\">Depuis le d\u00e9cret de novembre 2014, la <\/span><a href=\"https:\/\/www.gridky.com\/loi-pinel\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">loi Pinel<\/span><\/a><span style=\"font-weight: 400\"> encadre \u00e9galement la r\u00e9partition des charges dans un <\/span><a href=\"https:\/\/www.gridky.com\/blog\/bail-commercial-et-loi-pinel-lessentiel\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">contrat de bail commercial<\/span><\/a><span style=\"font-weight: 400\">. Les charges ici sont entendues comme charges locatives, travaux, taxes, imp\u00f4ts ou encore redevances\u2026 L\u2019objectif du d\u00e9cret \u00e9tant d\u2019apporter plus de transparence dans les baux commerciaux ainsi que de limiter les d\u00e9penses pour les travaux \u00e0 charge du locataire.<\/span><\/p>\n<h2>Ce que doit comporter le contrat de bail commercial<\/h2>\n<p><span style=\"font-weight: 400\">Le d\u00e9cret ordonne que le contrat de bail comprenne un <\/span><b>inventaire pr\u00e9cis des charges<\/b><span style=\"font-weight: 400\"> \u00e0 venir, et qui doit \u00eatre renouvel\u00e9 chaque ann\u00e9e conform\u00e9ment \u00e0 <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGIARTI000029103688\/2014-06-20\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">l&rsquo;article L145-40-2<\/span><\/a><span style=\"font-weight: 400\">\u00a0 du code du commerce. Le bailleur se doit de transmettre les pi\u00e8ces justificatives du montant des charges si le locataire en fait la demande. Par ailleurs, le bailleur doit informer le preneur en cas de modifications concernant les charges ou si il y a cr\u00e9ation de nouvelles charges au cours du contrat de location.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">En outre, une <\/span><b>liste explicite des travaux<\/b><span style=\"font-weight: 400\"> doit \u00eatre annex\u00e9e au contrat de bail commercial. Cet inventaire r\u00e9partit les travaux pass\u00e9s (sur les trois derni\u00e8res ann\u00e9es) avec les co\u00fbts support\u00e9s et les travaux \u00e0 venir (sur les trois prochaines ann\u00e9es) avec les co\u00fbts estim\u00e9s, entre le bailleur et le locataire. Ainsi le locataire se retrouve prot\u00e9g\u00e9 par une liste <\/span><b>limitative <\/b><span style=\"font-weight: 400\">des travaux qui seront consid\u00e9r\u00e9s comme \u00e0 sa charge. Cet \u00e9ch\u00e9ancier des travaux doit \u00eatre renouvel\u00e9 tous les trois ans apr\u00e8s la signature du bail.\u00a0<\/span><\/p>\n<h2>Les d\u00e9penses \u00e0 la charge du bailleur<\/h2>\n<p><span style=\"font-weight: 400\">En conformit\u00e9 avec les <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGIARTI000006429496\/1804-02-09\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">articles 605 et 606<\/span><\/a><span style=\"font-weight: 400\"> du Code Civil, <\/span><b>les travaux dits de \u201cgrosses r\u00e9parations\u201d ne peuvent \u00eatre imput\u00e9s au locataire<\/b><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Ainsi les d\u00e9penses concernant le b\u00e2timent en lui-m\u00eame, la toiture, les murs etc\u2026 seront essentiellement \u00e0 la charge du bailleur. Les mises aux normes qui impliquent de gros travaux, ou les grosses r\u00e9parations li\u00e9es \u00e0 la v\u00e9tust\u00e9 du bien sont \u00e9galement \u00e0 charge du bailleur. Les honoraires associ\u00e9s \u00e0 ces travaux de gros-\u0153uvre sont aussi imput\u00e9s au bailleur.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Les charges li\u00e9es \u00e0 la propri\u00e9t\u00e9 ne peuvent pas non plus \u00eatre imput\u00e9es au locataire.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">De fait, le bailleur ne peut mettre \u00e0 la charge du locataire des honoraires de gestion administrative des loyers par exemple. Ni les imp\u00f4ts, taxes ou redevances li\u00e9s \u00e0 la propri\u00e9t\u00e9 du bien.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Enfin, le bailleur ne peut pas reporter sur le locataire le co\u00fbt des travaux, des charges et autres taxes d\u2019un autre locataire ou d\u2019un bien non lou\u00e9.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">A noter que la loi consid\u00e8re les charges \u201cd\u2019embellissements\u201d comme pouvant \u00eatre imput\u00e9es au locataire. Cela signifie que si des travaux de r\u00e9paration ont lieu mais avec un montant de r\u00e9paration sup\u00e9rieur au prix d\u2019une r\u00e9paration \u00e0 l\u2019identique alors on consid\u00e9rera\u00a0 qu\u2019ils ont embelli l\u2019entit\u00e9 initiale, et ainsi les co\u00fbts de ces <\/span><b>travaux d\u2019embellissement pourront \u00eatre imput\u00e9s au locataire<\/b><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<h2>Les charges du locataire<\/h2>\n<p><span style=\"font-weight: 400\">Reste \u00e0 la charge du locataire les d\u00e9penses de r\u00e9parations courantes, d\u2019entretiens, li\u00e9es \u00e0 l\u2019occupation des lieux.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Ainsi les charges locatives imput\u00e9es au locataire sont:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Les d\u00e9penses courantes en \u00e9nergie (eau, \u00e9lectricit\u00e9, gaz) ;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Les charges de copropri\u00e9t\u00e9 comme l\u2019entretien des parties communes par exemple (quote-part de r\u00e9mun\u00e9ration du gardien, quote-part de l\u2019ascenseur\u2026)<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Les co\u00fbts de petites r\u00e9parations telles que les peintures, la plomberie, les dispositifs de chauffage\u2026<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">La taxe fonci\u00e8re, les taxes, redevances et imp\u00f4ts li\u00e9s \u00e0 un service b\u00e9n\u00e9fique au locataire (l\u2019enl\u00e8vement des ordures m\u00e9nag\u00e8res par exemple), ou encore li\u00e9s \u00e0 l\u2019usage du local.<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Les travaux d\u2019embellissement dont le montant exc\u00e8de celui de travaux de r\u00e9paration \u00e0 l\u2019identique<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Depuis le d\u00e9cret de novembre 2014, la loi Pinel encadre \u00e9galement la r\u00e9partition des charges dans un contrat de bail commercial.
