Depuis la <\/span><b>loi Alur du 24 mars 2014,<\/b><span style=\"font-weight: 400;\"> le bailleur dispose d\u2019un d\u00e9lai d\u2019un an \u00e0 partir de la date pr\u00e9vue de r\u00e9vision pour en informer le locataire et effectuer l&rsquo;augmentation du loyer. <\/span><b>Attention, la r\u00e9vision du loyer n\u2019est pas r\u00e9troactive<\/b><span style=\"font-weight: 400;\">. Cela signifie qu\u2019apr\u00e8s un an, la r\u00e9vision du loyer pour l\u2019ann\u00e9e pass\u00e9e n\u2019est plus possible. Il est \u00e9galement n\u00e9cessaire de pr\u00e9venir le locataire \u00e0 l\u2019avance de cette augmentation.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Par ailleurs, <\/span><b>cette augmentation ne doit pas exc\u00e9der L\u2019IRL<\/b><span style=\"font-weight: 400;\"> en vigueur : L\u2019IRL d\u00e9signe l\u2019indice de r\u00e9f\u00e9rence pour l\u2019augmentation des loyers et est <\/span><b>publi\u00e9 par L\u2019INSEE<\/b><span style=\"font-weight: 400;\"> chaque trimestre. <\/span><b>Il sert de plafond pour d\u00e9finir l\u2019augmentation<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Il se calcule comme ceci :\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-weight: 400;\">loyer hors charges en cours * IRL n \/ IRL n-1<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">(IRL n) d\u00e9signe L\u2019IRL de r\u00e9f\u00e9rence du contrat de bail<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">(IRL n-1) d\u00e9signe L\u2019IRL de r\u00e9f\u00e9rence l\u2019ann\u00e9e pr\u00e9c\u00e9dente \u00e0 la m\u00eame p\u00e9riode<\/span><\/i><\/p>\n<p><b>Entre deux baux, cela d\u00e9pend de la localisation de votre bien<\/b><span style=\"font-weight: 400;\"> : hors zone tendue la r\u00e9vision est libre, autrement il faudra respecter les lois en vigueur qui encadrent les loyers et ne pas exc\u00e9der l\u2019augmentation de L\u2019IRL.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dans les deux cas, (en cours de bail ou entre deux baux), si votre logement se trouve en <a href=\"https:\/\/www.gridky.com\/blog\/repartition-des-zones-de-la-loi-pinel\/\" target=\"_blank\" rel=\"noopener\">zone tendue<\/a> d\u2019autres param\u00e8tres sont \u00e0 consid\u00e9rer : c\u2019est le cas des sp\u00e9cificit\u00e9s de la loi Pinel (qui concerne surtout les logements neufs) et de ses plafonds de loyers impos\u00e9s.\u00a0<\/span><\/p>\n<h2>La Loi Pinel<\/h2>\n<p><span style=\"font-weight: 400;\">Depuis septembre 2014 et jusqu&rsquo;en d\u00e9cembre 2021, la <a href=\"https:\/\/www.gridky.com\/loi-pinel\" target=\"_blank\" rel=\"noopener\">Loi Pinel<\/a> offre des <\/span><b>avantages fiscaux<\/b><span style=\"font-weight: 400;\"> pour tout investisseur souhaitant investir dans l\u2019immobilier locatif neuf. Les r\u00e9ductions d\u2019imp\u00f4ts peuvent aller jusqu\u2019\u00e0 63000 euros et repr\u00e9senter<\/span><b> jusqu\u2019\u00e0 21% de la valeur du bien<\/b><span style=\"font-weight: 400;\"> s&rsquo;il est lou\u00e9 pendant une <\/span><b>p\u00e9riode de 12 ans<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ce dispositif avantageux vise \u00e0 pallier le manque de logement dans les zones d\u00eetes \u00ab\u00a0tendues\u00a0\u00bb et de permettre aux classes moyennes qui ont des ressources limit\u00e9es, sans pour autant avoir acc\u00e8s aux logements sociaux, d\u2019acc\u00e9der \u00e0 la location en zones tendues avec de moindres difficult\u00e9s. Les loyers sont donc encadr\u00e9s selon un d\u00e9coupage de zones plus ou moins tendues d\u00e9finies par la loi.\u00a0<\/span><\/p>\n<h2>Les sp\u00e9cificit\u00e9s de la loi Pinel pour augmenter les loyers<\/h2>\n<p><span style=\"font-weight: 400;\">Ainsi <\/span><b>sous la loi Pinel, le bailleur se doit de respecter les plafonds initiaux<\/b><span style=\"font-weight: 400;\"> lorsqu\u2019il d\u00e9fini le montant du loyer \u00e0 savoir, pour l\u2019ann\u00e9e 2020 :\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">En zone Abis (Paris) : 17,43\u20ac \/m\u00b2<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">En zone A : 12,95\u20ac\/m\u00b2<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">En zone B1 : 10,44\u20ac\/m\u00b2<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Quand il souhaite augmenter son loyer, le bailleur doit s\u2019assurer que <\/span><b>cette augmentation ne d\u00e9passera pas les plafonds Pinel en cours<\/b><span style=\"font-weight: 400;\">.
