Mais, qu\u2019en est-il du <\/span><b>report du d\u00e9ficit en LMNP ou LMP<\/b><span style=\"font-weight: 400;\"> ? Explications.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Les d\u00e9ficits en LMNP et LMP<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Pour les loueurs en meubl\u00e9s non professionnels (LMNP)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Il est possible de reporter les d\u00e9ficits issus d\u2019une LMNP pendant une p\u00e9riode de 10 ans. Attention : cela concerne uniquement les revenus qui proviennent d\u2019une LMNP.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Pour les loueurs professionnels (LMP)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Les d\u00e9ficits retir\u00e9s d\u2019une activit\u00e9 en LMP sont affect\u00e9s au revenu global sans aucune limitation en termes de montant. Dans le cas o\u00f9 le revenu global serait insuffisant, le d\u00e9ficit cr\u00e9\u00e9 est reportable pendant 6 ans. La d\u00e9termination des d\u00e9ficits doit r\u00e9pondre aux r\u00e8gles pos\u00e9es dans le code g\u00e9n\u00e9ral des imp\u00f4ts en mati\u00e8re de d\u00e9ductibilit\u00e9 des charges. Autrement dit, ils ne doivent pas \u00eatre issus des amortissements qui sont exclus des charges d\u00e9ductibles.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Le report du d\u00e9ficit en LMNP et LMP sur les plus-values immobili\u00e8res<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">Pour les loueurs en meubl\u00e9s non professionnels (LMNP)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">\u00c0 l\u2019issue d\u2019une vente, il n\u2019est pas rare qu\u2019une plus-value soit r\u00e9alis\u00e9e. Dans le cas de la cession de logements meubl\u00e9s, l\u2019imposition est identique aux plus-values classiques. En LMNP, ces transactions ne rel\u00e8vent pas des plus-values professionnelles.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les plus-values r\u00e9alis\u00e9es lors de la cession de vos locaux d&rsquo;habitation meubl\u00e9s sont impos\u00e9es comme des plus-values priv\u00e9es. Elles ne rel\u00e8vent donc pas du r\u00e9gime des plus-values professionnelles. Si vous avez pu b\u00e9n\u00e9ficier d\u2019une remise fiscale gr\u00e2ce au dispositif Censi-Bouvard et limiter vos amortissements, l\u2019incidence sur le calcul de la plus-value est nulle.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Pour les loueurs professionnels (LMP)<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Contrairement au LMNP, les investisseurs en LMP d\u00e9pendent du r\u00e9gime des plus-values professionnelles sur la vente de biens lou\u00e9s. Dans le cas d\u2019un investissement en Censi-Bouvard, le calcul de la plus-value est sp\u00e9cifique et est d\u00e9taill\u00e9 dans le bulletin officiel des finances <\/span><a href=\"http:\/\/bofip.impots.gouv.fr\/bofip\/3610-PGP.html?identifiant=BOI-BIC-CHAMP-40-20-20160203\"><span style=\"font-weight: 400;\">BOI-BIC-CHAMP-40-20<\/span><\/a><span style=\"font-weight: 400;\"> n\u00b0340.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Si l\u2019activit\u00e9 est exerc\u00e9e depuis au moins 5 ans, ces plus-values peuvent b\u00e9n\u00e9ficier d\u2019une exon\u00e9ration compl\u00e8te, \u00e0 condition que la moyenne des recettes issues de l\u2019activit\u00e9 de location des exercices termin\u00e9s sur les 2 derni\u00e8res ann\u00e9es civiles pr\u00e9c\u00e9dant la date de cl\u00f4ture de l\u2019exercice qui concerne la plus-value ne d\u00e9passe pas un plafond de 90 000 \u20ac HT et d\u2019une exon\u00e9ration partielle dans le cas o\u00f9 les recettes se situent entre 90 000 \u20ac HT et 126 000 \u20ac HT (<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006069577&amp;idArticle=LEGIARTI000006307441&amp;categorieLien=id\"><span style=\"font-weight: 400;\">article 151 septies du code g\u00e9n\u00e9ral des imp\u00f4ts<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00c0 noter que si l\u2019une de ces conditions n\u2019est pas remplie, les plus-values sont soumises au r\u00e9gime des plus-values et moins-values professionnelles \u00e0 court terme ou \u00e0 long terme, comme le pr\u00e9cise l\u2019<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006069577&amp;idArticle=LEGIARTI000006307682#:~:text=Aux%20plus%2Dvalues%20provenant%20de,b.\"><span style=\"font-weight: 400;\">article 39 duodecies du code g\u00e9n\u00e9ral des imp\u00f4ts<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Investir sous le statut LMNP ou LMP pr\u00e9sente de nombreux avantages.
