Alors, qu\u2019est-ce que <\/span><b>la loi Pinel dans l\u2019immobilier ancien<\/b><span style=\"font-weight: 400;\"> ?<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Qu\u2019est-ce que la loi Pinel dans l\u2019immobilier ancien et comment en b\u00e9n\u00e9ficier ?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">La loi Pinel dans l\u2019immobilier ancien est moins connue que celle dans le neuf. Elle concerne les biens qui ont d\u00e9j\u00e0 \u00e9t\u00e9 occup\u00e9s au moins une fois. Comme son homologue dans le neuf, le dispositif Pinel ancien devait \u00eatre supprim\u00e9 en 2017. Suite \u00e0 la mise en placedu gouvernement Macron, il a \u00e9t\u00e9 reconduit jusqu\u2019au 31 d\u00e9cembre 2021. La loi Pinel ancien, que l\u2019on nomme \u00e9galement \u201cPinel optimis\u00e9 au d\u00e9ficit foncier\u201d ou \u201cprogramme Pinel ancien r\u00e9habilit\u00e9\u201d, permet \u00e0 un investisseur de profiter des avantages fiscaux pr\u00e9vus par le dispositif dans le neuf, mais aussi du d\u00e9ficit foncier qu\u2019il est possible de cr\u00e9er. Pour en b\u00e9n\u00e9ficier, il faut :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">acheter un logement consid\u00e9r\u00e9 comme \u00e9tant inhabitable du fait de son insalubrit\u00e9 ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">r\u00e9aliser des travaux de r\u00e9novation ou de r\u00e9habilitation : le chantier doit imp\u00e9rativement s\u2019achever dans les 30 mois faisant suite \u00e0 l\u2019acquisition du logement ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">effectuer un diagnostic du bien \u00e0 l\u2019issue des travaux pour certifier de sa r\u00e9habilitation : l\u2019expert s\u2019attachera notamment \u00e0 \u00e9valuer si les crit\u00e8res de performances techniques et de d\u00e9cence ont \u00e9t\u00e9 respect\u00e9s ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">la mise en location du logement reprend les m\u00eames principes que le Pinel dans le neuf.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">Quels sont les logements qui sont concern\u00e9s par le dispositif ?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Deux types de biens ouvrent droit au Pinel dans l\u2019immobilier ancien :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">un logement d\u00e9labr\u00e9 ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">un local industriel ou commercial transform\u00e9 en habitation.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Pour juger de l&rsquo;insalubrit\u00e9 d\u2019un bien, l\u2019article 6 de la <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=LEGITEXT000006069108\"><span style=\"font-weight: 400;\">loi n\u00b089-462 du 6 juillet 1989<\/span><\/a><span style=\"font-weight: 400;\"> a instaur\u00e9 15 crit\u00e8res :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">l\u2019\u00e9tat du gros \u0153uvre ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">l\u2019\u00e9tat de la charpente ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">l\u2019\u00e9tanch\u00e9it\u00e9 \u00e0 la pluie et aux eaux de ruissellement ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">les dispositifs de retenue des personnes ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">la notion de plomb dans les peintures ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">l\u2019amiante ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">le r\u00e9seau d\u2019eau ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">les installations de gaz ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">les installations \u00e9lectriques ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Les installations sanitaires<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">l\u2019\u00e9tat de la cuisine ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">le chauffage ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">la ventilation ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">les parois et les menuiseries ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">l\u2019\u00e9tat global du logement.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Pour pr\u00e9tendre \u00e0 b\u00e9n\u00e9ficier de la loi Pinel dans l\u2019immobilier ancien, l\u2019\u00e9tat du bien ne doit pas r\u00e9pondre \u00e0 au moins 4 de ces points. S\u2019ajoutent \u00e0 ces crit\u00e8res 12 autres param\u00e8tres techniques \u00e0 prendre en consid\u00e9ration. Ils sont r\u00e9pertori\u00e9s dans l\u2019article 4 de l\u2019<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/affichTexte.do;?cidTexte=LEGITEXT000005733746\"><span style=\"font-weight: 400;\">arr\u00eat\u00e9 du 19 d\u00e9cembre 2003 du code g\u00e9n\u00e9ral des imp\u00f4ts<\/span><\/a><span style=\"font-weight: 400;\"> :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">une surface minimale habitable ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">pas de risques d\u2019accessibilit\u00e9 au plomb ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">l\u2019absence de flocage\/calorifugeage\/faux plafonds qui contiendraient de l&rsquo;amiante ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">les ouvrants de caract\u00e9ristique thermique &lt;= 2,9 W\/m\u00b2K ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">une installation \u00e9lectrique s\u00fbre ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">une installation du gaz aux normes ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">la pr\u00e9sence d\u2019un syst\u00e8me de chauffage ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">l\u2019\u00e9vacuation des eaux us\u00e9es et eaux-vannes ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">une pi\u00e8ce d\u00e9di\u00e9e aux toilettes et \u00e0 la douche ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">des WC \u00e9loign\u00e9s des pi\u00e8ces de vie principales ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">une protection solaire suffisant sur les baies vitr\u00e9es expos\u00e9es au soleil ;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">une isolation des combles si le logement en poss\u00e8de.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Si 6 de ces crit\u00e8res ne sont pas respect\u00e9s, le bien est consid\u00e9r\u00e9 comme \u00e9tant ind\u00e9cent et est \u00e9ligible au Pinel dans l\u2019immobilier ancien.<\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Vous souhaitez investir dans l\u2019immobilier locatif tout en profitant d\u2019avantages fiscaux, mais vous pr\u00e9f\u00e9rez acheter un bien ancien ?
